By accessing or using WorkTrac ("the Service"), operated by Happihack Studios LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
WorkTrac is a workforce management platform providing task management, time tracking, invoicing, scheduling, communication, safety compliance, and related tools via mobile applications, web dashboard, and API.
You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized access.
Paid plans are billed monthly or annually in advance via Stripe. Your subscription renews automatically unless cancelled before the renewal date. We may change pricing with 30 days' notice. Free trials include full Enterprise features and convert to the Starter plan unless upgraded.
You agree not to: (a) use the Service for unlawful purposes; (b) attempt to gain unauthorized access to our systems; (c) transmit malware, spam, or harmful content; (d) interfere with or disrupt the Service; (e) use the Service to harass, threaten, or discriminate against others; (f) resell or redistribute the Service without authorization.
You retain ownership of all data you upload or create in WorkTrac ("Your Data"). We do not claim ownership of Your Data. We use Your Data solely to provide and improve the Service. You may export Your Data at any time.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by factors outside our control.
To the maximum extent permitted by law, Happihack Studios LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
Either party may terminate this agreement at any time. You may cancel your subscription through the dashboard. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be retained for 30 days before deletion.
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance.
These Terms shall be governed by the laws of the State of Oregon, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Multnomah County, Oregon.
